Apr 19, 2010: 2010 Campaign Fails, Plus Some Legal Ju-Jitsu: This Week in Prop 8 for April 19, 2010

Everyone was predicting it, and now's it's finally happened: the Restore Equality 2010 campaign admitted that it didn't gather enough signatures for a 2010 repeal. So after all that arguing and debate and hard work, it's going to be 2012 after all, just like all the other major organizations wanted.

The next steps aren't clear: nobody's started pulling together a coalition for a 2012 campaign, so we're back to the post-Prop-8 power vacuum. It'll be interesting to see what organization steps up and gets the ball rolling on the next two years of campaigning.

Meanwhile, the legal maneuvering and out-maneuvering continues in Perry vs Schwarzenegger, the case against Prop 8. The big battle right now is over whether the ACLU and EQCA have to turn over some secret emails. They don't want to, but they may have to: even though the documents don't seem strictly relevant to the trial, the court has denied their appeal.

That doesn't leave many legal options. It's looking like the ACLU and EQCA's only choice is to refuse to turn over the documents, wait to be cited for contempt of court, and then appeal again. That citation may happen soon: the Yes-on-8 groups are already asking the court to find the No-on-8 groups in contempt.

Ultimately, all parties involved would like this case to wrap up as quickly as possible, so these delays are sure to get under everyone's skin -- especially Judge Walker's.
